On April 2, 2026, Erie County Judge Kenneth Case dismissed charges in a high-profile North Buffalo shooting case after ruling that prosecutors violated speedy trial rules and failed to provide required discovery materials in a timely manner to the defense. The Erie County District Attorney’s Office has since announced it will not pursue an appeal.
Tiveron Law Special Counsel attorney James Maloney represented Caron D. Fleming alongside attorney Robert Steinhaus. Fleming was charged in connection with a January 2024 shooting at Sahara Hookah Lounge on Hertel Avenue. He had been in custody for two years while the case proceeded through the court system.
Throughout the proceedings, the defense maintained that Fleming acted in self-defense, alleging he was being robbed and intended to testify at trial. Maloney and Steinhaus also raised concerns about the handling of evidence, including text messages between a key witness and a former assistant district attorney that they described as inconsistent and troubling. Those concerns included references to witnesses, video, and other materials not disclosed to the defense.
The case highlighted the importance of timely disclosure of evidence and strict adherence to procedural rules, both of which are fundamental to ensuring fairness and due process in criminal proceedings. Matters involving complex procedural issues often require close coordination between defense counsel and experienced trial attorneys.
